Notary Public Requirement

When completing a certificate of acknowledgement or a jurat, a notary public is required to certify to the identity of the signer of the document. Identity is established if the notary public is presented with satisfactory evidence of the signer's identity. "Satisfactory Evidence" means the absence of any information, evidence, or other circumstances which would lead a reasonable person to believe that the individual is not the individual he/she/they claim to be and (A) paper identification documents or (B) the oath of a single credible witness or (C) the oaths of two credible witness under penalty of perjury.

Apostille: Notary Authentication

An apostille certifies a document so countries in the 1961 Hague Convention will recognize it. An apostille is a federally-issued documents of authentication that seeks to simplify of legalizing and authenticating a notary public documents so that they can be recognized internationally in foreign countries that are members of the 1961 Hague Convention Treaty.

Each notary public is required to have and to use a seal. The seal must be kept in a locked and secured area, under the direct and exclusive control of the notary public, and must not be surrendered to an employer upon termination of employment, whether or not the employer paid for the seal, or to any other person.

A NOTARY PUBLIC SHALL NOT USE THE OFFICIAL SEAL OR THE TITLE NOTARY PUBLIC FOR ANY PURPOSE OTHER THAN THE RENDERING OF NOTARIAL SERVICE. (Government Code section 8228.1)
